When is a Scuba tank not a Scuba tank

The topic has been raised about tank inspections.
I dont know about the USA rules but in Australia if a tank is not used in water
and it is so labelled it will become a Industrial tank on a 5 year inspection.

That used to be the case here in New Zealand, but...

Cheap and dishonest divers started doing to avoid the annual inspections. So now, if it's a SCUBA tank it has to be tested every year, regardless of whether is goes in the water.

However, there is an alternative. BA (Breathing apparatus) tanks that have been retired from the Fire Department only need testing every 5 years, so some people have these to fill their air pistols.

My local dive shop accepts that the tank has only been used for surface use if it has a gauge on it.
